PREZENTARE GENERALĂ Bun venit la W3DPrint! Termenii "noi", "nouă" și "nostru" se referă la W3DPrint, operat de SAC Concept SRL. W3DPrint operează acest magazin și site web, inclusiv toate informațiile, conținutul, funcționalitățile, instrumentele, produsele și serviciile aferente, pentru a vă oferi o experiență de cumpărături personalizată ("Serviciile"). W3DPrint este alimentat de Shopify.

Vă rugăm să citiți cu atenție acești Termeni și Condiții, deoarece conțin informații importante despre drepturile dumneavoastră legale.

Prin vizitarea sau utilizarea Serviciilor noastre, sunteți de acord să fiți legat de acești Termeni și Condiții și de Politica noastră de Confidențialitate.

SECȚIUNEA 1 - ACCES ȘI CONT Prin acceptarea acestor Termeni, declarați că aveți vârsta majoratului în țara dumneavoastră de reședință. Sunteți singurul responsabil pentru securitatea datelor de autentificare ale contului dumneavoastră și pentru toate activitățile desfășurate în cont.

SECȚIUNEA 2 - PRODUSELE NOASTRE Am depus toate eforturile pentru a oferi o reprezentare exactă a produselor noastre. Culorile sau aspectul produselor pot diferi față de cum apar pe ecranul dumneavoastră. Ne rezervăm dreptul de a modifica descrierile produselor sau de a întrerupe orice produs în orice moment.

SECȚIUNEA 3 - COMENZI Când plasați o comandă, faceți o ofertă de cumpărare. W3DPrint își rezervă dreptul de a accepta sau refuza orice comandă. Comanda nu este acceptată până când W3DPrint confirmă acceptarea și procesează plata. Vă rugăm să verificați cu atenție comanda înainte de a o trimite, deoarece anulările pot să nu fie posibile după acceptare.

SECȚIUNEA 4 - PREȚURI ȘI FACTURARE Prețurile, reducerile și promoțiile sunt supuse modificărilor fără notificare prealabilă. Prețul perceput va fi cel valabil la momentul plasării comenzii. Prețurile afișate nu includ, dacă nu se specifică altfel, taxe, transport sau alte taxe vamale.

SECȚIUNEA 5 - LIVRARE Nu suntem răspunzători pentru întârzierile de livrare. Toate termenele de livrare sunt estimative și nu sunt garantate. Nu suntem responsabili pentru întârzierile cauzate de curierii de transport, procesarea vamală sau evenimente în afara controlului nostru. Odată ce transferăm produsele către curier, riscul trece asupra dumneavoastră.

SECȚIUNEA 6 - PROPRIETATE INTELECTUALĂ Serviciile noastre, inclusiv mărci comerciale, texte, imagini, grafice și alte conținuturi, sunt proprietatea W3DPrint / SAC Concept SRL și sunt protejate de legislația română și europeană privind proprietatea intelectuală. Nu aveți dreptul să reproduceți, distribuiți sau modificați niciun material de pe site fără consimțământul nostru scris prealabil.

SECȚIUNEA 7 - INSTRUMENTE OPȚIONALE Este posibil să aveți acces la instrumente oferite de terți ca parte a Serviciilor, asupra cărora nu avem control. Nu suntem răspunzători pentru nicio daună rezultată din utilizarea acestor instrumente opționale.

SECȚIUNEA 8 - LINKURI CĂTRE TERȚI Serviciile pot conține linkuri către site-uri operate de terți. Nu suntem responsabili pentru conținutul sau acuratețea acestor site-uri și nu suntem răspunzători pentru nicio daună rezultată din accesarea lor.

SECȚIUNEA 9 - RELAȚIA CU SHOPIFY W3DPrint este alimentat de Shopify. Orice vânzare și cumpărare efectuată în magazinul nostru se realizează direct cu W3DPrint / SAC Concept SRL. Shopify nu este responsabil pentru niciun aspect al tranzacțiilor dintre dumneavoastră și W3DPrint.

SECȚIUNEA 10 - POLITICA DE CONFIDENȚIALITATE Toate informațiile personale colectate prin Servicii sunt supuse Politicii noastre de Confidențialitate. Prin utilizarea Serviciilor, confirmați că ați citit această politică.

SECȚIUNEA 11 - FEEDBACK Dacă trimiteți idei, sugestii, recenzii sau feedback, ne acordați o licență perpetuă, mondială, fără redevențe, de a utiliza, reproduce și publica aceste materiale în orice scop, inclusiv comercial.

SECȚIUNEA 12 - ERORI, INEXACTITĂȚI ȘI OMISIUNI Ne rezervăm dreptul de a corecta orice erori, inexactități sau omisiuni și de a modifica informații sau anula comenzi dacă orice informație este inexactă, fără notificare prealabilă.

SECȚIUNEA 13 - UTILIZĂRI INTERZISE Puteți accesa și utiliza Serviciile numai în scopuri legale. Nu puteți utiliza Serviciile pentru scopuri ilegale, pentru a încălca drepturi de proprietate intelectuală, pentru a hărțui sau prejudicia alte persoane, pentru a transmite informații false sau înșelătoare.

SECȚIUNEA 14 - ÎNCETARE Putem înceta acest acord sau accesul dumneavoastră la Servicii în orice moment, fără notificare. Veți rămâne răspunzător pentru toate sumele datorate până la data încetării.

SECȚIUNEA 15 - DECLINAREA GARANȚIILOR SERVICIILE ȘI TOATE PRODUSELE SUNT FURNIZATE "CA ATARE" ȘI "DUPĂ DISPONIBILITATE", FĂRĂ NICIO REPREZENTARE, GARANȚIE SAU CONDIȚIE DE NICIUN FEL, EXPRESĂ SAU IMPLICITĂ.

SECȚIUNEA 16 - LIMITAREA RĂSPUNDERII ÎN MĂSURA MAXIMĂ PERMISĂ DE LEGE, W3DPrint / SAC Concept SRL NU VA FI RĂSPUNZĂTOR PENTRU NICIUN PREJUDICIU INDIRECT, INCIDENTAL, PUNITIV, SPECIAL SAU CONSECVENT DE NICIUN FEL REZULTAT DIN UTILIZAREA SERVICIILOR SAU A PRODUSELOR.

SECȚIUNEA 17 - DESPĂGUBIRE Sunteți de acord să despăgubiți și să exonerați de răspundere W3DPrint / SAC Concept SRL, Shopify și afiliații noștri pentru orice pierderi, daune sau pretenții rezultate din încălcarea acestor Termeni, violarea oricărei legi sau utilizarea Serviciilor.

SECȚIUNEA 18 - LEGEA APLICABILĂ Acești Termeni și Condiții sunt guvernați și interpretați în conformitate cu legislația României și a Uniunii Europene. Orice dispute rezultate din acești Termeni vor fi supuse jurisdicției exclusive a instanțelor competente din România.

SECȚIUNEA 19 - MODIFICĂRI ALE TERMENILOR Ne rezervăm dreptul de a actualiza sau modifica acești Termeni în orice moment. Continuarea utilizării Serviciilor după orice modificare constituie acceptarea acestora.

SECȚIUNEA 21 - DREPTUL DE RETRAGERE (UE)

În conformitate cu Directiva UE 2011/83/UE și OUG 34/2014, dacă sunteți consumator în Uniunea Europeană, aveți dreptul de a vă retrage din contract în termen de 14 zile de la primirea produsului, fără a oferi nicio justificare.

Termenul de retragere expiră după 14 zile de la data la care dumneavoastră sau un terț indicat de dumneavoastră (altul decât transportatorul) intră în posesia fizică a produsului.

printr-o declarație neechivocă (de exemplu, o scrisoare trimisă prin poștă sau e-mail) cu privire la decizia dumneavoastră de retragere din contract.

Excepții de la dreptul de retragere: Dreptul de retragere nu se aplică pentru:

• Produse fabricate la comandă sau personalizate conform specificațiilor consumatorului
• Produse care au fost utilizate sau deteriorate după livrare

În cazul retragerii, vă vom rambursa toate plățile primite, inclusiv costurile de livrare (cu excepția costurilor suplimentare rezultate din alegerea unui alt tip de livrare decât livrarea standard), fără întârzieri nejustificate și în orice caz cel târziu în termen de 14 zile de la data la care suntem informați cu privire la decizia dumneavoastră de retragere. Vom efectua rambursarea folosind același mijloc de plată ca cel folosit pentru tranzacția inițială.

SECȚIUNEA 22 - SOLUȚIONAREA ONLINE A LITIGIILOR (ODR)

În conformitate cu Regulamentul UE nr. 524/2013, consumatorii din Uniunea Europeană au dreptul de a utiliza platforma de soluționare online a litigiilor (ODR) pusă la dispoziție de Comisia Europeană pentru soluționarea litigiilor contractuale.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

SECTION 7 - OPTIONAL TOOLS You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

However, any sales and purchases you make in our Store are made directly with W3DPrint / SAC Concept SRL. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and W3DPrint, including any injury, damage, or loss resulting from purchased products and services.

SECTION 17 - INDEMNIFICATION You agree to indemnify and hold harmless W3DPrint / SAC Concept SRL, Shopify, and our affiliates from any losses, damages, liabilities or claims arising out of your breach of these Terms, your violation of any law, or your use of the Services.

SECTION 18 - GOVERNING LAW These Terms of Service shall be governed by and construed in accordance with the laws of Romania and the European Union. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Romania.

SECTION 19 - CHANGES TO TERMS OF SERVICE We reserve the right to update or change these Terms of Service at any time. Your continued use of the Services following any changes constitutes acceptance of those changes.

SECTION 21 - RIGHT OF WITHDRAWAL (EU)

In accordance with EU Directive 2011/83/EU, if you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason.

The withdrawal period expires after 14 days from the day on which you or a third party indicated by you (other than the carrier) acquires physical possession of the product.

Exceptions to the right of withdrawal: The right of withdrawal does not apply to:

• Products made to order or customized according to consumer specifications
• Products that have been used or damaged after delivery

In case of withdrawal, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the standard delivery), without undue delay and in any event no later than 14 days from the day we are informed of your decision to withdraw. We will carry out the reimbursement using the same means of payment as you used for the initial transaction.

SECTION 22 - ONLINE DISPUTE RESOLUTION (ODR)

In accordance with EU Regulation No. 524/2013, consumers in the European Union have the right to use the Online Dispute Resolution (ODR) platform provided by the European Commission for resolving contractual disputes.
